Presidential authority within the constitutional democracy of the United States has posed a continuous and evolving potential threat to the integrity of a government formed by the people for the people. Whether by the machinations and ambitions of the personally ambitious and influential, or by an endemic tendency for all social systems to unify and in doing so, centralize authority, a pattern of political and judicial evolution toward Presidential supremacy is evident in the political history of America. The mounting supremacy of Presidential authority in the United States presents a profound and complex challenge for the present generation and the determination of exactly where and how the Presidents authority can be checked will prove to be of great consequence for the future of not only domestic, but international, affairs. Hamiltons suggestion that a robust and energetic leader is a desirable consequence in a democracy: Energy in the Executive is a leading character in the definition of good government. It is essential to the protection of the community against foreign attacks; it is not less essential to the steady administration of the laws (Hamilton), the potential for the dangerous expansion (and possible supremacy) of Presidential authority exists within the original Constitution. The executive authority given the President led many of the original framers to express reticence regarding the development of a new monarch. Some modern political scientists believe that this is exactly what is taking place now and has been taking place over the course of US political history: we have changed our constitutional democracy into a political democracy[ ] substituted an unwritten for a written constitution and a government of laws for a government of men. This means that the principles of the American Revolution, as the foundation of our constitutional system, have been destroyed and that we have returned to the principles of the British system. (Patterson, 1947, p. ) Such a dire pronouncement may seem like hyperbole, however, several key points contribute to this rather scathing indictment. First, there is the issue of national unity, a fact which modern communications, transportations, educational and economic systems have made unavoidable. Since 1789 the movement toward national unity has developed far more rapidly. In this respect, we have only followed the law of the life of nations, beginning in isolation, passing through confederation, and ending in unity. (Patterson, 1947, p. 6) Unity heralds a sole leader, rather than a confedaration of leaders. Secondly, the two-party political system has allowed for the centralization of political power within the congress. The powers necessary for presidential supremacy had first to be centralized in the Congress before the control of the Congress by the President would give him national supremacy. The President has facilitated this movement by urging the Congress to seize power to enact his policies into law and by making appointments to the Supreme Court. (Patterson, 1947, p. 7) The movement toward unity entails the expansion of the federal bureaucracy, which in turn, enhances Presidential authority. The tremendous growth in the functions of the national government have necessarily multiplied executive agents by the hundreds of thousands. The President cannot perform this multiplicity of services without authority and without an army of subordinates. (Patterson, 1947, p. 77) These factors, plus the politicization of the ensuing civil and legislative offices, greatly enhance the scope of Presidential authority. The fact that the President has become our political executive is not exclusively a result of the development of political parties though without a party system, or a party in the totalitarian sense, there could be no political executive. (Patterson, 1947, p. 84) Perhaps one of the most critical and complex issues which faced the framers of the United States constitution was that of how to limit the government and associated governmental beuracacy while ensuring that the Federal government retained enough power and authority to interpret and enforce the constitution itself. As Madison remarks in the opening lines of his now-famous Federalist #51, there can be no more urgent an issue, nor one which so directly confronts both the self-interested nature of the individual, but the self-interested nature of government itself: to what expedient, then, shall we finally resort, for maintaining in practice the necessary partition of power among the several departments, as laid down in the Constitution? (Madison, 1788). The partition of power is a key phrase and contains within it the seeds of Madison answer to his own opening, rhetorical question. Madison offers a direct and seemingly mandatory vision of how the partition of power should be best accomplished: The only answer that[ ] by so contriving the interior structure of the government as that its several constituent parts may, by their mutual relations, be the means of keeping each other in their proper places (Madison, 1788). This conclusion is commonly referred to as the system of checks and balances upon which the democracy of the United States is founded. Madisons observations in Federalist #51 are frank and founded upon concerns that the basic self-interests of human-beings, coupled with the leviathan power of the State pose the continual potential for dictatorship and the subversion of the constitution itself. In this light, there is an almost exclamatory tone to Madisons writing and there is, without a doubt, a tone of warning in the following, famous passage: But the great security against a gradual concentration of the several powers in the same department, consists in giving to those who administer each department the necessary constitutional means and personal motives to resist encroachments of the others[ Ambition must be made to counteract ambition. The interest of the man must be connected with the constitutional rights of the place. (Madison, 1788) In Colonial times, no mistake would have been about just what kind of encroachments of others Madison meant to illustrate: the potential of personal ambition to trump the idealism of a democratic government founded upon principles of liberty and equality. Similarly, the idea of connecting the interests of the individual with constitutional principles is an exceedingly complex idea, but one which would have been explicit, in consequence, to the Colonial framers of the constitution. Madison means no less than: all citizens of a democracy must put the principles of that democracy, its traditions, its institutions, laws, and integrity above their personal ambitions and self-interests. The subtext of this, of course, is that all mens self-interests are ultimately best-served by a government which enables them to live free and which enables them to pursue their self-interests to a point of true liberty; however, the maintenence of the constitution and the democratic state, which are, in actuality, protections against the propensity of governments to turn oppressive and hostile, must be regarded as more essential, more important than the mere personal self-interests of those who serve in government. Against this summation, Hamiltons assertion that responsibility has two aspects becomes hat much more provocative: Responsibility is of two kinds to censure and to punishment. The first is the more important of the two, especially in an elective office. Man, in public trust, will much oftener act in such a manner as to render him unworthy of being any longer trusted, than in such a manner as to make him obnoxious to legal punishment (Hamilton). What Hamilton is saying is that the concentration of power and responsibility in the figure of the President leads to a greater amount of accountability in government. By contrast, Madison viewed the American people, as a whole, as being the firewall of the democratic traditions the President was theoretically bound to serve. However, the idea that individuals in high positions of power must function both as facilitators of the democracy but also as a check against the possible tyranny of the majority is also an idea which Madison sets forth in this paper which is quite a radical idea: Different interests necessarily exist in different classes of citizens. If a majority be united by a common interest, the rights of the minority will be insecure (Madison, 1788). In conclusion, Hamiltons Federalist #70 is one of the most important political documents associated with the framing of the US constitution and forms a remarkable counterpoint to Madisons thought. Both writings represent an attempt by the framers to pinpoint the points of danger and structural weakness in both the democratic form of government and the innate nature of the citizens who comprise that democracy.

Every morning I wake up at the last minute. I press snooze from the moment my alarm goes off at 6:50 a.m. to 7:45 a.m. I go to bed early, but I can’t seem to get enough sleep. Teens are supposed to sleep for at least eight to nine hours every night. Having school start at 8:30 a.m. doesn’t help because teens like me have to work at night. After work I get home late and have homework to do before school the next morning, which keeps me up past midnight sometimes. Studies show that even getting a half an hour more of sleep improves children’s learning ability from eighteen to forty-four percent (School Really). If school started later teens would improve their grades and their health. Concentration from students is obviously one of the most important aspects in learning new things. It has been proven that if students sleep in, even if it’s only a half hour longer than normal, they’re more likely to have better concentration, behavior, and overall health. â€Å"A sleep disorder not only results in a sleepy, cranky, and often poor-performing student at school, but also an irritable, unhappy child or teenager at home† (Debatewise). Teenagers have a lot of stress put on them. One of the main stresses in teen’s lives is not getting enough sleep. Most teenagers have a job to help support their families and pay for their car insurance, gas, and other things they need. On top of having a job, many teenagers are in sports that occupy a lot of their free time. Teenagers are also pressured into getting all of their homework done in short amounts of time just to get good grades. The last thing that teenagers are worried about is sleep. Teenagers don’t realize how important sleep is not only to their education, but their health in general. ... ...l should start later varies. For one, it’s dangerous to drive to school tired. Automobile accidents are most commonly caused by inexperienced drivers. I can’t stress enough how important it is to get good grades. Getting good grades and having a good GPA, not only helps you become who you want to be when you get older, but it helps you get into any college you like.

Internal Factors While external factors are important, internal factors are just as important when designing a benefit plan for an organization. When implementing a benefit plan, managers must take into consideration any internal factors that might affect the organization administratively. Examples of administrative cost are establishing the pay structure within the organization, conducting wage surveys and implementing the wage structure for positions within the organization. Conclusion Providing additional incentives such as educational benefits, health, dental, vision and life insurance along with paid vacation is beneficial to the organization as well as the employee. My areas are fiction, journalism, nonfiction, and playwriting. I’ve published two novels and I edit and develop nonfiction with writers and publishers. Here’s some broad-stroke advice from these areas: = A professional text matters! It matters that a book read well, have proper punctuation, spelling, and grammar. It matters that you follow the Chicago Manual of Style (for books and magazines). Or proper film or TV format. Or AP style for newspapers and journals that require it. = Learn the lingo. For instance, â€Å"a fiction novel† is redundant; a novel is always fiction. = If you are writing nonfiction and presenting yourself as an expert, you should be an expert. That means you’ve published on the topic, you work professionally in your area or you teach the topic, you have academic credentials in the topic, you have undergone training where you were evaluated = If you can’t afford a professional edit for your book, read Chicago Manual of Style, 16th edition. Actually READ it. It will not only tell you rules and lingo, but it offers a pretty good course in publishing. = Read all the articles in Writer’s Market. First Victim At about 12:35 a.m. on August 5, 1992, Robinson burglarized the home of Joan Burghardt, 29, who lived alone in a one-bedroom apartment on the first floor of a residential apartment complex on the east side of Allentown. He broke through the screen on the patio door, which was locked, and ripped just enough to slip his hand through the doorknob and open it. Burghardt reported the burglary and the missing $50 from a drawer in her bedroom dresser. Everything else seemed undisturbed. Four days later at around 11:30 a.m. on August 9, 1992, Burghardts neighbor telephoned the police to complain that Burghardts stereo had been on for three days and nights and that no one answered the doorbell. She also reported that the screen had been out of the window for three nights and during one of those nights she heard Burghardt screaming and banging the wall and sounds as if she was being beaten up. When the police arrived, they found Burghardt dead, lying on the living room floor. She had been severely beaten about the head. The autopsy revealed that Burghardt had been sexually assaulted and hit over the head at least 37 times, fracturing her skull and damaging her brain. She also had defensive injuries on both hands, indicating that she was alive during at least some of the attack. Seminal stains were found on a pair of shorts found at the scene, suggesting that a male had masturbated on them. Second Victim Charlotte Schmoyer, 15, was always diligent about delivering the Morning Call newspaper on her assigned route on the east side of Allentown. When she failed to deliver the paper on the morning of June 9, 1983, one of her customers scanned the street for the young carrier. She did not spot Schmoyer, but what she did see alarmed her enough to phone the police. Schmoyers newspaper cart was left unattended, for more than 30 minutes, in front of a neighbors house. When the police arrived, they found that the newspaper cart was half-filled with newspapers, and Schmoyers radio and the headset had been strewn on the ground between two houses. There were also finger streaks on the windowpane of the door to the nearby garage of one of the houses. Based on the scene the police concluded that Schmoyer had likely been abducted. The police began their search and found her bicycle abandoned along with some of her personal property. Within hours a tip came in, and investigators began searching a wooded area where they found blood, a shoe, and the body of Charlotte Schmoyer buried under a stack of logs. According to the autopsy report, Schmoyer was stabbed 22 times, and her throat was slashed. Also, there were cutting and scraping wounds in her neck area, indicating they were inflicted while the Schmoyer was conscious and her neck bent down. She had also been raped. Investigators were able to collect blood samples, a pubic hair and a head hair on Schmoyer that did not match her blood and hair. The evidence was later matched to Robinson through DNA. Burglary John and Denise Sam-Cali lived on the east side of Allentown, not far from where Schmoyer had been abducted. On June 17, 1993, Robinson burglarized their home while the couple was away for a few days. He had taken Johns gun collection, which was kept in a bag in the closet. Within days John bought three new guns, one of which he purchased for Denise for protection. The couple grew even more concerned about their safety after learning that someone had broken into their neighbors home and attacked their child. Third Victim On June 20, 1993, Robinson entered a womans home and choked and raped her five-year-old daughter. The child managed to live but based on her injuries it appeared that he had intended for her to die. Some theorized that he was actually after the childs mother, but when he found her sleeping with her partner, he attacked the child instead. Fourth Victim On June 28, 1993, John Sam-Cali was out of town, and Denise was alone. She awoke to the sounds Robinson was making from inside the walk-in closet near her bedroom. Frightened, she decided to try to run out of the house, but he grabbed her, and they struggled. She managed to get out of the house, but Robinson grabbed at her again and pinned her down onto the ground in the front yard. As the two fought, she was able to bite him on the inside of his arm. He repeatedly punched her, sliced her lip open and then raped her, however, her screams alerted a neighbor who turned on her porch light, and Robinson ran away. When the police arrived, they found Denise alive, but severely beaten, with strangulation marks around her neck, and her lip deeply slashed. They also found a butcher knife wrapped in a napkin lying outside the bathroom door. After recovering in the hospital, the Sam-Calis went out of town for a few days. Fifth Victim On July 14, 1993, Robinson raped and murdered Jessica Jean Fortney, 47, in the living room of her daughter and son-in-laws home. She was found dead, half-naked and her face was swollen and black. There was blood spatter on the wall indicating she had died a violent death. The autopsy revealed that Fortney died in the early morning hours after being strangled and severely beaten. It was also determined that she had been raped. What Robinson did not know was that Fortneys granddaughter had witnessed the killing and was able to give the police his description. Back to Finish the Job On July 18, 1993, the Sam-Calis returned home. Before going out of town, they had the house equipped with a burglar alarm. At about 4:00 a.m. Denise heard a noise in the house and then the back door opened, setting off the alarm and the intruder, Robinson, took off. After that, the Allentown police set up a sting operation and arranged for a police officer to stay in the Sam-Cali home every night. They thought the man who attacked her was coming back to kill her because she could identify him. Their hunch was right. Officer Brian Lewis was staked out inside the Sam-Cali home when at around 1:25 a.m. on July 31, 1993, Robinson returned to the house and tried to open doors. Lewis heard the noises, then watched as Robinson broke into the house through a window. Once he was entirely inside, Lewis identified himself as a police officer and told Robinson to halt. Robinson began shooting at Lewis and gunfire was exchanged. Lewis went to the Sam-Calis bedroom to warn the couple to stay inside the room. He then called for backup. In the meantime, Robinson escaped by breaking through several glass panels on a wooden door in the kitchen. The police found a blood trail in the kitchen and out the door. Cost $10 for forms | 2. 4 Evaluate the Risks The funds required to manage risks for the event is in the order of $11,305. The Board of Management will be required to approve those funds as soon as possible. Of highest risk is liability claims so safety announcements must be made regularly in all communications before and during the event. Therefore allowing for feedback and suggestions to be obtained on the protocols.Insurance cover must be purchased for the event. Other risks can be mitigated by hiring security, event professionals, nurse, having paramedics on standby, providing equipment and signs, having volunteers and parents bring food as well as keeping constant watch on the children. 2. Risk Treatments (Avoid; Reduce likelihood; Reduce consequences; transferring the risk; Retaining the risk) 2 weeks prior to BBQ, have staff meeting and allocate a superv isor to relocate the party repeatedly when necessary to quieten the stressful noises and/or situations. Allocate staff duties for obtaining supplies, contacts and communications with sponsors and parents in particular.Ensure staff is familiarised with OHS procedures for the event so they can provide safety announcements to everyone. As well as manage people before, during and after the event. Allocate staff to survey for feedback and suggestions; as well as approach the Board, parents, staff and sponsors for volunteers and funds. Check and approve the RSVP list, include any roles & responsibilities. 1 week prior,call & request that parents who RSVP for the BBQ volunteer their time and resources for the event. As well as bring a plate of food or drinks to share if they can. Make parents into paid staff if necessary via signed contracts. 4 days prior, hire security from network of staff or parents to be on alert, warn and/or request disruptors to leave the event. days prior, provide r amp to sponsor’s truck driver to use at event and ensure both driver and Santa is familiarised with OHS procedures. Ensure external staff is qualified and licenced to work with children. On day of event, ensure that staff knows the protocols for the truck driver, Santa, parents and children to keep everyone in line. Signs are posted and safety announcements made at regular intervals. Start hosting the event and allocate amplifier and communication equipment to staff. 3. 1 Recommended Response and Impact By developing a timed action plan in order to reduce, minimise, and isolate the exposure to risks. Ensuring all adults agreed to always control and take responsibility of the children ahead of the event.Ensuring the Sponsor driver and Santa is police checked and licensed to work with children. Check carefully over every thing via lists and contacts before the start of the event. By determining the importance of each risk. Analyse the frequency of exposure to the associated ris ks. By developing an evacuation and crowd control plan with staff. By communicating all procedures with staff. 4. Implementation Implementation follows all of the plans for mitigating the risks. Purchase insurance policies for the risks that have been decided to be transferred to an insurer. Avoiding all risks that can be avoided without sacrificing the organisation's goals. 4. 1 Proposed ActionsSet up meeting with the board of management to approve funding. Meeting with staff, management and volunteers for briefing of roles and responsibilities. Hire extra resources and/or professionals. Send out invitations. Obtain list of RSVP stakeholders and approve. Contact stakeholders for additional support. Purchase insurance coverage for the event. Ensure everything goes as planned via lists and contacts. Obtain final report from supervisor.Include recommendations into the following event planning and timing. 4. 2 Proposed Communication Email staff, parents and management via memos and newsletters. Call everyone to follow up on their roles, responsibilities and ensure attendances. Make calls to hire, appointments to approve and sign contracts with professionals; including purchasing insurance coverage for the event. Call or radio personnel at event to maintain an alerted net of safety. Email, call and or post thank you letters and invite to post event feedback. Email, call supervisor for reporting and or meeting. Email management the final planning proposal for the next event. 4. 3 Responsibilities (Internal and External)Management- ensure all funding is provided, lists and plans are in place. Including insurance, hiring, contracts, appointments, equipment and venues are appropriate. Communicate via memos, newsletters and calls to action. Staff- supervisor to take charge of everyone on day of event and all survey reporting. Volunteers- assist staff and parents with their responsibilities. Hired Professionals- provide equipment and services before and during event. Sponsor Driver- use safety equipment and performs role responsibly as instructed by staff. Santa- ensure kids and parents are all happy with his role. Parents- take responsibility of the children and offer any support required on day of event. 4. 4 Timing Before event:Send out invitations 1 months prior. Have RSVP list of names, roles and responsibilities ready for staff meeting 2 weeks prior. Hire all external staff 2 weeks prior to event on signed contracts; including volunteers. Ensure they are qualified and licenced to work with children. Ensure insurance is purchased to cover all equipments, planned events and catering are all in place and ready to go 1 week prior. Ensure everything goes according to plan via lists and contacts within the week leading into the event. D uring event: Place signs and handout flyers of the event timetable. Ensure everyone is allocated their places and equipment, roles and responsibilities.Ensure staff makes regular safety checks and announcements according to plan. Fills out attendance sign in/out forms and accident book when required. That only people with appropriate footwear, clothing, sunscreen and head cover are allowed entry. Ensure all hired professionals perform in a satisfactory manner. Ensure hosting and activities are on time and obtain feedback of satisfaction levels. After event: Hold parent teacher meeting within 1week. The supervisor was to analyse results of surveys and monitoring of effective and ineffective procedures from the event. During the meeting, supervisor reports on effective, ineffective protocols and their impact on enjoyment.All stakeholders can also provide additional inputs; which will be noted by the supervisor. Helpful suggestions can be implemented as additional notes to the report. Include the report in the Risk Register file. 4. 5 Resource requirements (funds, people, equipment, etc. ) In addition to staff, volunteers, parents and children, sponsor driver and Santa, equipments, planning and catering for the event. Internet, mobile phones and/or walkie talkies, office equipment and supplies are required to contact, communicate and disperse people & equipments for the event. The centre's resources are already equipped to provide these points of call. 5. Reporting and MonitoringAll stakeholders are invited to provide feedback and suggestions before, during and after the event to make the party an enjoyable experience for everyone involved. The supervisor is to gather, analyse and report on survey results from staff. The report can be communicated to all stakeholders in a parent teacher meeting 1 week after the event. Of importance is highlighting all effective and ineffective protocols, with emphasis on safety. The effect that stakeholders felt the safety protoc ols had on their enjoyment is also required. The final report would be included into the Risk Register. Implement the effective procedures into next year’s christmas party plan and timing sheets. With emphasis on avoiding or minimising the ineffective.
